1. Acceptance of Terms

By accessing and using SongSearchers, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on SongSearchers for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modifying or copying the materials
  • Using the materials for any commercial purpose or for any public display
  • Attempting to decompile or reverse engineer any software contained on SongSearchers
  • Removing any copyright or other proprietary notations from the materials
  • Transferring the materials to another person or "mirroring" the materials on any other server

3. Disclaimer

The materials on SongSearchers are provided on an 'as is' basis. SongSearchers makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Limitations

In no event shall SongSearchers or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on SongSearchers, even if SongSearchers or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on SongSearchers could include technical, typographical, or photographic errors. SongSearchers does not warrant that any of the materials on its website are accurate, complete, or current. SongSearchers may make changes to the materials contained on its website at any time without notice.

6. Links

SongSearchers has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by SongSearchers of the site. Use of any such linked website is at the user's own risk.

7. Modifications

SongSearchers may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which SongSearchers operates, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

9. User Accounts & User Types

If you create an account on SongSearchers, you are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

SongSearchers has two user types: Musicians/Creators (Listers) and Clients (Hirers). Each role has different permissions and responsibilities as outlined in these terms.

10. Payment Terms for Creators

Profile activation is a one-time payment of $9.99 USD (limited time offer, normally $19.99). Payment is processed through Stripe and provides permanent profile activation. Once activated, your profile remains live until you choose to deactivate it. You may deactivate your profile anytime through your account settings. Refunds are not available after profile activation. There are no recurring charges or monthly subscriptions.

11. Messaging System & Communication

For Clients (Hirers): You may message Creators directly through our platform. Rate limits apply: you may send 1 message per day per Creator, maximum 5 different Creators per day. If a Creator does not respond for 7 days, a 7-day cooldown applies before you can message that Creator again.

For Creators (Listers): You may receive messages from Clients. You can optionally share contact details (email, phone, Instagram, Twitter) during profile setup. These contact details will only be visible to Clients in your message conversations if you choose to display them. You can reply to messages freely without rate limits.

All messages are stored on our servers and associated with your account for record-keeping purposes.

12. Prohibited Conduct

You agree not to:

  • Harass, abuse, or threaten other users
  • Spam or send unsolicited bulk messages
  • Attempt to circumvent rate limits or messaging restrictions
  • Post offensive, defamatory, or illegal content
  • Misrepresent your identity or qualifications
  • Use the platform for illegal activities or transactions
  • Attempt to scrape, crawl, or collect profile data without permission

13. Content & Intellectual Property

By uploading content (audio samples, images, portfolio links) to SongSearchers, you retain all rights to your content. You grant SongSearchers a non-exclusive, royalty-free license to display your content on the platform and in search results. You represent and warrant that you have the right to share all content uploaded.
